Copyright and DMCA: takedowns and counter-notices

VideoBB respects the rights of creators and responds to notices of claimed infringement under the Digital Millennium Copyright Act (DMCA) and equivalent laws.

Sending a takedown notice

Where to send it

Send it with the contact form, topic "Copyright notice (DMCA)".

What the notice must include

1. The URL of each VideoBB video you believe infringes your work.
2. Identification of the copyrighted work, with a link or description.
3. Your name, address, telephone number and email.
4. A statement that you have a good-faith belief the use is not authorised by the owner, its agent or the law.
5. A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for the owner.
6. Your physical or electronic signature.

What happens after a valid notice

Valid notices result in removal of the video and a notice to the uploader. Repeat infringers lose their account.

Counter-notice

If your video was removed and you believe it was a mistake or that you hold the rights, send a counter-notice.

What a counter-notice must include

• Your contact details.
• The URL of the removed video.
• A statement under penalty of perjury that the removal was mistaken.
• Consent to the jurisdiction of your local federal court.

What happens after a counter-notice

We forward the counter-notice to the claimant. If they do not file an action within 10 business days, the video may be restored.

Fair use

Commentary, criticism and education can be fair use, but that is decided case by case. If you are unsure, do not upload it.

Creative Commons

Uploaders can mark videos as Creative Commons Attribution in the studio, which tells others how they may reuse it.
